Definitions

Content: All elements constituting the information present on the Site, including texts – images – videos.

 

Cookie: An information file sent to the User’s browser and stored on the User’s device.

 

Personal Data: “Information that allows, in any form whatsoever, directly or indirectly, the identification of the natural persons to whom it applies” (Article 4 of Law No. 78-17 of January 6, 1978).

The terms “personal data”, “data subject”, “processor”, and “sensitive data” have the meaning defined by the General Data Protection Regulation (GDPR: No. 2016-679).

 

User: Any professional, natural person capable in the sense of the Civil Code, or legal entity, who visits the Site subject to these general terms and conditions.

  1. General Terms of Use for the Site and Services Offered.

The Site constitutes a work of authorship protected by the provisions of the Intellectual Property Code and applicable international regulations. The User may not in any way reuse, assign, or exploit for their own account all or part of the elements or works of the Site.

 

Use of the Site implies full and complete acceptance of the general terms of use described below. These terms of use may be modified or supplemented at any time. Users are therefore invited to consult them regularly.

 

The Site is normally accessible to Users at all times. However, an interruption for technical maintenance may be decided by Galvatek, which will then endeavor to communicate the dates and times of the intervention to Users in advance. The Site is updated regularly. Similarly, the legal notices may be modified at any time: they are nevertheless binding on the User, who is invited to refer to them as often as possible to become aware of them.

 

  1. Description of Services

The purpose of the Site is to provide information concerning all the company’s activities. Galvatek strives to provide the most accurate information possible on the Site. However, it cannot be held responsible for omissions, inaccuracies, or deficiencies in updates, whether due to its own actions or those of third-party partners who provide this information.

 

All information indicated on the Site is provided for informational purposes only and is subject to change. Furthermore, the information on the Site is not exhaustive. It is provided subject to modifications that may have occurred since its online publication.

 

  1. Contractual Limitations on Technical Data.

The Site uses JavaScript technology. Galvatek cannot be held responsible for material damages related to the use of the Site. Furthermore, the User undertakes to access the Site using recent equipment, free of viruses, and with an updated, latest-generation browser. The Site is hosted by a service provider within the territory of the European Union, in accordance with the provisions of the General Data Protection Regulation (GDPR: No. 2016-679).

 

The objective is to provide a service that ensures the best accessibility rate. The host ensures the continuity of its service 24 hours a day, every day of the year. However, it reserves the right to interrupt the hosting service for the shortest possible durations, particularly for maintenance, improvement of its infrastructure, infrastructure failure, or if the Services generate traffic deemed abnormal.

 

Galvatek and the host cannot be held responsible in the event of a malfunction of the Internet network, telephone lines, or computer and telephony equipment, particularly due to network congestion preventing access to the server.

 

  1. Intellectual Property and Infringements.

Galvatek is the owner of the intellectual property rights and holds the rights of use on all elements accessible on the Site, including texts, images, graphics, logos, videos, icons, and sounds. Any reproduction, representation, modification, publication, or adaptation of all or part of the elements of the Site, regardless of the means or process used, is prohibited, except with prior written authorization from GALVATEK.

 

Any unauthorized use of the Site or any of its elements will be considered an infringement and prosecuted, particularly in accordance with the provisions of Articles L. 335-2 and following of the Intellectual Property Code.

  1. Limitations of Liability.

Galvatek acts as the publisher of the site. Galvatek is responsible for the quality and veracity of the Content it publishes.

 

Galvatek cannot be held responsible for direct and indirect damages caused to the User’s equipment when accessing the Galvatek website, resulting either from the use of equipment not meeting the specifications indicated in point 4, or from the appearance of a bug or incompatibility.

 

Galvatek cannot also be held responsible for indirect damages (such as, for example, loss of market or loss of opportunity) resulting from the use of the Site. Interactive spaces (the possibility to ask questions in the contact area) are available to Users. Galvatek reserves the right to delete, without prior notice, any content posted in this area that would violate applicable French legislation, particularly the provisions relating to data protection. If necessary, Galvatek also reserves the right to hold the User civilly and/or criminally liable, particularly in the event of a message of a racist, insulting, defamatory, or pornographic nature, regardless of the medium used (text, photograph, etc.).

 

  1. Management of Personal Data.

The Client is informed of the regulations concerning marketing communication, the Law of June 21, 2014, on confidence in the Digital Economy, the Data Protection Act of August 6, 2004, as well as the General Data Protection Regulation (GDPR: No. 2016-679).

 

7.1 Controllers of Personal Data Collection

For Personal Data collected during the creation of the User’s personal account and their navigation on the Site, the data controller for Personal Data is: Galvatek. Galvatek is represented by David Kalisiak, its legal representative.

 

As the controller of the data it collects, Galvatek undertakes to comply with the framework of current legal provisions. It is notably up to the User to establish the purposes of their data processing, to provide their prospects and clients, based on the collection of their consents, with complete information on the processing of their personal data, and to maintain a processing register that conforms to reality. Each time Galvatek processes Personal Data, Galvatek takes all reasonable measures to ensure the accuracy and relevance of the Personal Data with regard to the purposes for which Galvatek processes it.

 

7.2 Purpose of Collected Data

Galvatek may process all or part of the data:

  • to enable navigation on the Site and the management and traceability of services ordered by the User: Site connection and usage data, invoicing, order history, etc.
  • to prevent and combat computer fraud (spamming, hacking, etc.): computer equipment used for navigation, IP address, password (hashed)
  • to improve navigation on the Site: connection and usage data
  • to conduct optional satisfaction surveys on the Site: email address
  • to conduct communication campaigns (SMS, email): phone number, email address

 

Galvatek does not market Personal Data, which is therefore only used out of necessity or for statistical and analytical purposes.

 

7.3 Right of Access, Rectification, and Objection

In accordance with current European regulations, Users of the Site have the following rights:

  • right of access (Article 15 GDPR) and rectification (Article 16 GDPR), to update, complete User data, right to restrict processing or erasure of User personal data (Article 17 GDPR), when they are inaccurate, incomplete, ambiguous, outdated, or whose collection, use, communication, or retention is prohibited
  • right to withdraw consent at any time (Article 13-2c GDPR)
  • right to restriction of processing of User data (Article 18 GDPR)
  • right to object to the processing of User data (Article 21 GDPR)
  • right to data portability of data provided by Users, when this data is subject to automated processing based on their consent or a contract (Article 20 GDPR)
  • right to define the fate of User data after their death and to choose to whom Galvatek should communicate (or not) their data to a third party they have previously designated

 

As soon as Galvatek becomes aware of the death of a User and in the absence of instructions from them, Galvatek undertakes to destroy their data, unless its retention is necessary for evidentiary purposes or to comply with a legal obligation.

 

If the User wishes to know how Galvatek uses their Personal Data, request its rectification, or object to its processing, the User may contact Galvatek in writing at the following address:

In this case, the User must indicate the Personal Data they would like Galvatek to correct, update, or delete, by identifying themselves precisely with a copy of an identity document (identity card or passport).

 

Requests for deletion of Personal Data will be subject to the obligations imposed on Galvatek by law, particularly regarding the retention or archiving of documents. Finally, Galvatek Users may lodge a complaint with the supervisory authorities, particularly the CNIL (https://www.cnil.fr/fr/plaintes).

 

7.4 Non-Disclosure of Personal Data

Galvatek prohibits itself from processing, hosting, or transferring information collected on Users to a country located outside the European Union or recognized as “non-adequate” by the European Commission without prior notification to the User. However, Galvatek remains free to choose its technical and commercial subcontractors, provided that they offer sufficient guarantees with regard to the requirements of the General Data Protection Regulation (GDPR: No. 2016-679).

 

Galvatek undertakes to take all necessary precautions to preserve the security of Personal Data, and in particular to ensure that it is not communicated to unauthorized persons. However, if an incident affecting the integrity or confidentiality of Personal Data is brought to Galvatek’s attention, it must inform the User as soon as possible and communicate the corrective measures taken. Furthermore, Galvatek does not collect any “sensitive data”.

 

Personal Data may be processed by Galvatek subsidiaries and their subcontractors (service providers), exclusively for the purposes herein.

 

Within the limits of their respective responsibilities and for the purposes recalled above, the main persons likely to have access to Users’ Personal Data are primarily our customer service agents.

 

7.5 Types of Data Collected

A – Data Collected During Site Navigation

Consultation of the Site does not require mandatory registration or identification. It can be carried out without the User communicating any nominative data concerning them (name, first name, address, etc.).

 

The essential Personal Data collected at this level consists of a cookie ID, which is a unique identifier for each session that ensures the proper functioning and security of the Site.

 

B – Data Collected and Processed within the Framework of the Commercial Relationship

Galvatek collects the User’s Personal Data based on its legitimate interest and for the following purpose: during the creation of a customer account following the User’s request for a quote or an order.

  • Billing Address
  • Delivery Address
  • Phone Number
  • Email Address
  • SIRET

 

If the User does not wish to submit Personal Data when it is necessary for the execution of a contract or a service they request, or when it is required by law, they will not be able to receive the requested product or service.

 

The information that the User may communicate via the contact form on the Site allows Galvatek to:

  • Process Users’ questions or requests for information,
  • Inform them about products and services,
  • Send them, subject to their agreement, a newsletter or advertising or commercial prospecting messages,
  • Offer them to participate in satisfaction surveys

 

The User has a right of access, rectification, portability, modification, and deletion concerning the data that concerns them. They can exercise this right by sending a letter to the following address: info@galvatek.fr.

 

The information essential for Galvatek to fulfill the missions described above is indicated by an asterisk on the different pages of the site. Other information is optional and allows Galvatek to better understand Users and improve communications and services towards them.

 

  1. Incident Notification

Regardless of the efforts made, no method of transmission over the Internet and no method of electronic storage is completely secure. Galvatek therefore cannot guarantee absolute security. If Galvatek became aware of a security breach, it would notify the affected Users so that they could take appropriate measures. Incident notification procedures take into account legal obligations, whether at national or European level. Galvatek undertakes to fully inform Users of all matters relating to the security of their account and to provide them with all necessary information to help them comply with their own regulatory reporting obligations.

 

No Personal Data is published without the User’s knowledge, exchanged, transferred, assigned, or sold on any medium to third parties. Only the hypothesis of the acquisition of Galvatek and its rights would allow the transmission of said information to the potential acquirer, who would in turn be bound by the same obligation to retain and modify Personal Data vis-à-vis the User.

 

Security

To ensure the security and confidentiality of Personal Data, Galvatek uses networks protected by standard devices such as firewalls, pseudonymization, encryption, and passwords.

 

When processing Personal Data, Galvatek takes all reasonable measures to protect it against any loss, misuse, unauthorized access, disclosure, alteration, or destruction.

 

  1. Hyperlinks, Cookies, and web tags

9.1. Hyperlinks

 

The Site contains a number of hyperlinks to other websites, established with Galvatek’s authorization. However, Galvatek is unable to verify the content of the sites thus visited, and consequently assumes no responsibility for this.

 

9.2. Cookies

Cookies include information such as the User’s domain name, the User’s Internet service provider, the User’s operating system, as well as the date and time of access. Cookies cannot under any circumstances damage the User’s device.

 

The User has the option to refuse the presence of Cookies on their device via the module provided for this purpose.

  1. Applicable law and jurisdiction.

Any dispute in connection with the use of the Site is subject to French law. Unless prohibited by law, exclusive jurisdiction is hereby granted to the competent courts of Versailles.
